
John King Successfully Negotiated the Settlement of a Multi-Million Dollar Residential Design-Build Project on behalf of the Architect for Nuisance Value
John King successfully settled a multi-million dollar residential construction lawsuit brought by homeowners against the design-build team for a high-end home in Burlington County, New Jersey. Mr. King argued that the economic loss doctrine precluded the homeowners’ direct claim of negligence against our client, the design-builder’s subconsultant architect with whom the plaintiffs did not have a contract. Plaintiffs contracted with the general contractor who in turn retained the architect’s services to prepare “permit plans” and not a full set of construction documents. Plaintiffs’ theory of negligence against the architect was the architect failed to prepare a full set of construction documents, but since the architect was only retained to prepare a “builders” set of plans to obtain a permit, Mr. King was successful in negotiating a nuisance settlement with plaintiffs for the cost of preparing a summary judgment motion.
